§ 847.211 Death of employee during election opportunity period

5 CFR 847.211(a)(a) When an employee eligible to make an election under this subpart dies before expiration of the time limit under § 847.206, the employee is deemed to have made the election and to be covered, at time of death, by the retirement system that covered the employee before the qualifying move.

5 CFR 847.211(b)(b) The deemed election under paragraph (a) of this section does not apply if the eligible survivor elects to have it not apply.

5 CFR 847.211(c)(c) An election by the survivor to decline the deemed election must be in writing and filed no later than 30 days after the employing agency notifies the survivor of the right to decline the deemed election.
